American PuritanismIn fewer than 250 words, begin a thread in which you respond to the following question: If Mary Rowlandson and Anne Bradstreet were the only two 17th-century puritans in the world and the works you’ve read the only written record of puritanism, what would you say is a defining quality of puritanism?Offer some original thinking. Leave aside any textbook definitions of ‘puritan,’ and don’t bother to explore Google. Instead, based upon your own examination of these primary texts, identify one common theme that Bradstreet and Rowlandson (our two puritans) seem to share.Support your idea with accurate, precise evidence. For both authors, point out (with careful cited paraphrase and/or accurate and cited quote) the sentences(s) where in the text you see evidence of the theme you have identified and, to the extent necessary, explain why you believe those sentences illustrate the theme you claim.

ABC Inc. designs and manufactures switches used in telecommunications. Serious flooding throughout the state of Tennessee affected ABC’s facilities. Inventory was completely ruined, and the company’s computer system, including all accounting records, was destroyed. Before the unfortunate incident, recovery specialists cleaned the buildings. The company controller is very nervous and anxious to recover whatever records he can to support the insurance claim for the destroyed inventory. After consulting with the cost accountant, they decide to retrieve the previous year’s annual report for the beginning inventory numbers. In addition, they also agreed that they need first quarter cost data. The cost accountant was working on the first quarter results before the storm hit, and to his surprise, the report was still in his desk drawer. After reviewing the data , the information shows the following information: Material purchases were $ 325,000; Direct Labor was $ 220,000. Further discussions between the controller and the cost accountant revealed that sales were $ 1,350,000 and the gross margin was 30% of sales. The cost accountant also discovered, while sifting through the information, that cost of goods available for sale was $ 1,020,000 at cost. While assessing the damage, the controller determined that the prime costs were $ 545,000 up to the time of the damage and that manufacturing overhead is 65% of conversion cost. The cost accountant is not sure about all of this, but he decides to see what he can do with the information. The beginning inventory numbers are as follows:Raw Materials, $ 41,000Work in Process, $ 56,000Finished Goods, $ 35,000Required:Determine the amount of cost in the Raw Materials, Work in Process, and Finished Goods Inventory as of the date of the storm. ( Hint: You may wish to reconstruct the various schedules and statements that would have been affected by the company’s accounts during the period.)

Write 11 pages thesis on the topic circumstances in which a constructive trust may be imposed upon a trustee. Constructive trusts arise by operation of common law principles and are by and largely implied by circumstances and facts particularly in respect of the conduct, statements, and intention of the relevant parties where applicable. The most common circumstance in which a constructive trust may arise is when a party makes some contribution toward the intrinsic value of the property with the understanding that he will acquire some interest in that property. These kinds of circumstances usually arise in and over the respective interests of co-habitants of a dwelling house. In these types of scenarios, a constructive trust may be imposed upon a trustee.

Lord Diplock defined the circumstances in which a constructive trust will be imposed. He maintained that there is no real distinction between the concept of resulting, implied, and constructive trusts. Trusts of this nature are:

“…created by a transaction between the trustee and the cestui que trust in connection with the acquisition by the trustee of a legal estate in land, whenever the trustee has so conducted himself that it would be inequitable to allow him to deny to the cestui que trust a beneficial interest in the land acquired. And he will be held to have so conducted himself if by his words or conduct he has induced the cestui que trust to act to his own detriment in the reasonable belief that by so acting he was acquiring a beneficial interest in the land.”2

In this case, Gissing v Gissing offers a comprehensive understanding of the nature of constructive trust and the manner in which it will arise in equity. The facts and circumstances of this case lend itself to the development of the law regarding intention and the interpretation of the intention.

Gissing v Gissing was a case where the legal title to the matrimonial home was held in the husband’s name only. The court had to determine whether or not the husband held the legal title as trustee for both himself and his wife. And if the court was satisfied with the facts that the husband was a trustee, how should the beneficial interest in that property, to be divided.

2. Numbers and Conversions (TCO 4)

The following has one compile time bug. This bug only generates a warning in some compilers and would cause an exception during runtime. Visual Studio 2012 actually gives us an error at compile time. This is better, because you should never do the thing that causes this error. Fix the error and run the program. Compare the output to the code and answer the questions found after the code.

Here is the code.

Questions

1.    When storing a floating point number into an integer variable, does it truncate or round?

2.    When the floating point numbers were printed out at higher precision, they were not the same value as entered. Research this issue and explain why.

3.    The setprecision(12) command either sets the precision for 12 places after the decimal point or 12 digits total; select the right option for each case below.

a.    fixed [total/after the decimal point]

b.    scientific [total/after the decimal point]

c.    float [total/after the decimal point]

4.    Based on the results of taking the square root and then squaring again, what would you say about the accuracy of floating point arithmetic in C++?

5.    Dividing by zero in earlier compilers generates an error and an exception. What does Visual Studio 2012 produce as the result of dividing by zero?
