Sarah Power is the top salesperson for X-Way Technologies. She is so good at her job that Best Technologies offer her a job at a 25% increased salary package. Sarah accepts the offer and resigns, giving two weeks notice as required by her contract. However, she has 6 months remaining on her employment contract. The companies do not compete in the same markets, so there is no noncompetition issue. Harry, her X-Way sales manager is livid. He calls Best Technologies and tells them that Sarah falsified her resume and is uncivil in the office (neither is true). Best Technologies rescinds the offer.

Who has what claims against whom, and what defenses may be available? That is, who could X-Way sue and why? Who could Sarah sue and why? Who could Best Technologies sue and why?

Wayne Inc. (“Wayne” or “the Company”), an SEC registrant, is a fashion retailer that sells men’s and women’s clothing and accessories. As an incentive to its employees, the Company established a compensation incentive plan in which a total of 100,000 options were granted on January 1, 20X1. On that date (the grant date), Wayne’s stock price was $15.00 per share.

The significant terms of the incentive plan are as follows:

• The options have a $15.00 “strike” or exercise price (the price the employee would pay to purchase a share of stock if the options vest).

• For the options to vest, the following must occur:

o The employee must continue to provide service to the Company throughout the entire explicit service period of five years (i.e., a five-year “cliff-vesting” award).

o The Company must achieve annual sales of at least $20 million during the fifth year of the explicit service period.

o The Company’s share price must increase by at least 25 percent over the five-year explicit service period.

• In addition, if the Company achieves sales of at least $25 million during the fifth year of the explicit vesting period, the strike price of the options will decrease from $15 to $10.

• The options expire after 10 years following the grant date.

• The options are classified as equity awards.

Additional Facts:

             • Assume it is probable at all times that 100 percent of the employees receiving the awards will continue providing service to the Company as employees for the entire five-year explicit service period and that the five-year explicit service period is determined to be the requisite service period.

 • On the grant date, Wayne’s management determined that it is probable that the Company’s sales in year 5 will be $30 million, and therefore it is probable on the grant date that sales are greater than or equal to at least $25 million.

• The grant-date fair value of the options assuming a strike price of $15 is $8 per option. The grant-date fair value assuming a strike price of $10 per option is $12 per option.

Required:

1. What types of conditions are present in the plan for the vesting of the units? Are they service, performance, market, or “other” conditions?

2.How do the service, performance, and market conditions affect vesting of the units? Of the various conditions present in the awards:

     a. Which affect the vesting of the award?

    b. Which affect factors other than vesting of the award and what is their accounting treatment?

3. As described above, on January 1, 20X1 (the grant date), $30 million of sales were probable for year 5. During years 1, 2, and 3, $30 million of sales for year 5 remained probable. At the beginning of year 4, management determines that it is probable that only $22 million of sales will occur for year 5. What are the proper accounting treatment and journal entries for each year?

 4. Through the end of year 5, Wayne’s share price remained at $15 and therefore the market condition was not met. What is the accounting impact of the market condition not having been met?

ents are readily available, a majority of those afflicted with the disease go untreated because health insurance companies refuse to pay at all or just part a certain percentage (Walters & Rotgers, 2012).&nbsp.This makes some of the victims to end up being homeless, while others may die an early death in response to a missed opportunity for treatment due to the health insurance companies’ neglect and discrimination on the issue (Walters & Rotgers, 2012).&nbsp.

Substance abuse comprises of two main types of addictions namely drug addiction and alcoholism.&nbsp. Drug addiction refers to the dependence on a street drug or on an over the counter medication while alcoholism is the dependence on alcohol. In this context, alcohol is referred to as a drug since it fits the description of a drug, which is defined as any substance that alters normal human homeostasis.&nbsp. Once an individual is addicted to a substance, he or she cannot avoid using it irrespective of their desires to stop the habit because of the harm it might be causing to them. The American Medical Association (AMA) defines drug addiction and alcoholism as some of the major lifestyle diseases in the 21st century that may be a result of genetics, environment, or upbringing.

There are numerous approaches that are applied in administering substance abuse treatment. However, some of these treatment methods are ineffective because they neglect not only the substance abuse dependency but also other causative factors such as comorbid mental illness and or any previous traumatic events that may have occurred in the individuals past that may have contributed to the substance abuse. Applications of such ineffective strategies leave substance abuse victims still struggling to maintain sobriety and have a successful life with stability and security in all aspects. An effective substance abuse treatment in individuals with any other causative factors must be inclusive of all factors and illnesses to be effective not only

Complete 3 page APA formatted essay: Neurology Clerkship eBook.

2. The “best” instruction for the eBook should be efficient in a way that it demands less time from the learners to allow for achievement of the goals. effective in a way that it facilitates acquisition of identified skill and knowledge by a learner. and appealing in such a way that it interests and motivates the learner, thus promoting participation in the learning task(McGrane & Lofthouse, 2012).

4. The evaluation of the instructional eBook should include evaluation of its instructional effectiveness among the Neurology clerkships and evaluation of the performance of the learners.(McGrane & Lofthouse, 2012) Information concerning evaluation of the instruction is enough for guiding revision of the instruction with the view to making it appealing, efficient, and effective.

The process of determining instructional materials’ effectiveness through randomized large-scale experiments is uncommon due to its high expenses and increased time requirements. Various smaller studies have been carried out in the view of examining how effective it is to introduce new packages of instructional approaches in comparison to the existing ill-defined instructional approaches. Most of these studies offer useful information concerning exploitation of alternative instructional methods such as the development of an instructional e-Book for Neurology Clerkship among Medicine students. However, there are various limitations.

One of the limitations of this study is the failure of evaluating most of the instructional approaches, especially among studies that offer useful information to practitioners and policymakers (Andrews, 2013). This is a problem that worsens with the exploitation of web-based open-source instructional materials such as the instructional eBooks. Another important issue is the constant nature of the studies even as they remain outdated and unable to suit the constantly updated instructional approaches. As such,
